The rulings by the 2022 SCOTUS court highlights the limits that are inherit in a republic structured like ours in America. It has become an organization where nine people are making decisions on a range of issues that they neither have the experience nor the capacity to learn or understand for all nine billion (and growing) people on earth. We (humaity as a whole) are quickly moving past the structures of the nation state, even if it may not seem like it. Why do I think this?
Lets look at the long term remifications of the decision in the West Virginia v EPA case. https://www.supremecourt.gov/opinions/21pdf/20-1530_n758.pdf?uuid=LGq9oGcGSzJGqc8y0676
THERE WAS A ripple of laughter in the US Supreme Court on February 21 when Justice Elena Kagan said: “We are a court—we really don’t know about these things. We are not, like, the nine greatest experts on the internet.”
Yet they feel comfortable making decisions on these things that they ‘don’t really know about’ that affect billions of people. When historians and fictional writers ask the question, ‘How do once great republics or long standing nation states fail?’ Or, ‘How does a global society break down into an unrecognizable structure that pits those without resources against each other where only a very small percentage control the resources that matter?’
This is how it happens. It is these decisions that are one more degree added to the pot of water that is slowly boiling humanity, like the proverbial frog without realizing it is being cooked. Every time these uneducated idiots, yes that is accurate because they know that they know nothing about the internet or technology or science and climate change, make a ruling that dictates policy or causes more legislation because of their ignorance they crank the temperature on humanity up one more degree.
The Supreme Court is arguably the most powerful legislative body in the world and they have the most influence and reach based on the nature and structure of the American republic. And throughout their history, due to the makeup of its members over time, they are also one of the most conservative and religiously biased bodies. In this, they have forced religion on billions of people over a wide range of issues from the internet to climate change in a way that would appal the founding fathers of our country. Why do I believe this? Because in the founding of our country one of the basic building blocks was freedom from religion. Yet, here we are 250 years later with the modern equivalent of kings and queens on thrones making choices about things they know nothing of and forcing the consequences onto, not just americans, all of humanity.
How can I say that? Given the current place in the world organization that America occupies, legal policy set by the supreme court affects anyone who ends up in the network of our ecosystem. Be that the internet, business or the tangential effects commerce and trade have on biology, life and the planet - e.g climate change.
This is what I see as both the limits of a specialized nation state. Those like the supreme court justices who have no practical knowledge of how the world works but are empowered to dictate how people in it function solely because of the specialized legal education that they may have. Some don’t even seem to be very competent in their specialization which is even more frightening and begs the question how much does that hasten the speed of decline to the nation states and global human society?
So whats the answer?
